CHAPTER 13

Singularly, one of the best ways to stop foreclosure on your home.

Bankruptcy is in Federal Court not state court.  You pay your debts through a "Chapter 13 Plan."  You and your attorney develope the plan especially for your mortgage arrears and once confirmed by the court, your creditors must accept your plan.  The plan payments are made to the Chapter 13 Trustee who is appointed by the Court to oversee your case for thirty [30] to sixty [60] months.

The foreclosure is stopped as soon as the voluntary petition is filed.

The requirements:
-  must have current income to pay your expenses moving forward;
-  must have filed or be prepared to file all your necessary tax returns
   both federal and state;
-  with a few exception, you may not have filed a prior bankruptcy 
   within the past year.

Bankruptcy is not a "do it yourself" project!
